AG Garland Trumps Drama Queen Hillary?
WaPo’s Marc Thiessen opines Hillary’s destroyed emails seem ‘lot more serious’ than reason for Trump raid as FBI may’ve seized “declassified” docs protected by atty & exec privilege after AG/DOJ refused indy review.
As Thiessen explained on Fox: “The [FBI’s] warrant says Trump had 11 sets of classified documents, including 4 sets of [highest level] top secret special access program documents … But [then FBI-director] Jim Comey told us that in 2016 that Hillary Clinton had 110 classified emails on her private server … including, 7 email chains” of top secrets also classified at the highest level that Justice’s inspector general said were “compromised by foreign intelligence services.” As for “intent” to commit a crime, esp. under the 1917 Espionage Act, it’s questionable that Trump “packed up those boxes” while Hillary “actually put classified information into an unclassified email” by physically “typing it out.”
Meanwhile, in an exclusive report on Sunday based on “sources familiar with the FBI investigation”, Fox says the seized “sets” and “boxes” of documents were long disputed by Trump’s lawyers & those objections “may have” been based on long-standing law on attorney and executive privilege, including the right to “declassify” them; after the DOJ issued a subpoena, they maintained they had asked DOJ for an independent review of disputed docs by a “special master”, but the agency refused. It’s not clear that the judge who issued the FBI warrant to raid was made aware of those details. Instead of issuing another subpoena and/or motioning the court for “compliance” as is usually done pro forma, AG Garland ok’d the raid. Was Mr. Trump right, then, in saying “all they needed to do was ask … [but] … wanted drama” instead? And, was he also right in suggesting a suddenly vacationing Pres Biden had to have known about the raid on his home?
