Biden Trumped As Supremes Uphold Remain In Mexico

The Supremes dampened Biden’s Open Borders mantra by reinstating Trump’s “Remain in Mexico” Policy for asylum applicants.


You’ll recall President Biden had by executive order reversed President Trump’s “Migrant Protection Protocols,” saying they forced vulnerable migrants to wait for court dates in violent border cities, while an appeals court had recently ruled Biden’s paroling them willy nilly en masse into the US violated federal law. But, in an unsigned order refusing to override that appellate ruling, the majority of six Justices suggested Mr. Biden’s attempt to undo the Trump policy might be viewed as “arbitrary & capricious.” Three liberal Justices dissented.


As the WSJ noted, practically speaking, “Remain in Mexico” hasn’t been used since 2019 and “the start of the Covid-19 pandemic” as officials under both the Trump and Biden administrations “have been turning back migrants under DCD public-health orders.” Yet, Texas & Missouri urged the High Court to sustain RIM for the future because it was “a necessary response to a flood of migrants at the border” and the reality that “more than 80% of asylum claims ultimately were rejected.” They added that the Trump, not the Biden, approach was the “humanitarian” way to go: “By eliminating the ‘free ticket into the US, MPP served to discourage such futile & dangerous journeys” and, therefore, was an “indispensable tool in addressing the ongoing crisis at the southern border.” Meanwhile, the WSJ noted, the Biden Administration is trying to “renegotiate” the MPPs with Mexico.
