Hawaii Sues Big Oil, Begs 4 Shellacking
US Supreme Court already ruled states can’t sue oil companies in federal court for pollution damage, but that didn’t stop Hawaii from suing in state court under state law. Supremes now agreed to hear & will chop down Hawaii’s wild wail.
The WSJ editorial board suggest as much since Hawaii’s state court end-around was already tried … and failed … in New York. The editors were also pretty blunt in concluding, regardless of all the legalistic nonsense in trying to dodge the realities of the real world: “If Honolulu and California can punish companies for emissions from oil produced in Texas and burned in China, there’s no limit to states’ power to tax and regulate beyond their borders.”
Put another way: “It’s a uniquely internation problem and legal issue, stupid.” Unfortunately, Hawaii’s Supreme Court ok’d this stinker of a lawsuit, so closure has yet to be reached. Prediction: “The U.S. Supreme Court will give the complaining environmentalists what they’re begging for: A legal shellacking.
