Indy Review of Trump Raid Docs Taints DOJ?

As judge oks Trump motion for Indy review of docs seized by FBI, she undercuts DOJ claim No. 45 had no “executive privilege” as well as atty-client rights. If so entire witch hunt now tainted by inadmissible evidence?


WSJ reports the Florida judge’s appointment of a special master to review docs seized by the FBI in its raid on Trump’s Mar-a-Lago home “temporarily blocks the government from using the materials for a criminal investigation,” although it can keep up its “national-security review”, whatever that means. However, Fox News’ legal analyst & former federal prosecutor, Andy McCarthy, noted the judge’s ruling “potentially” blows up the DOJ’s main argument in getting the raid warrant in the first place and since. That is, DOJ lawyers have insisted Mr. Trump enjoyed no executive privilege once he left office so’s to possess let alone keep many of the documents seized from the executive branch (e.g., DOJ) he left behind. And, if it turns out those docs were, indeed, rightfully in Trump’s possession, McCarthy warned, the entire DOJ investigation could be tainted after so many FBI & especially DOJ staffers have already seen what they shouldn’t have seen during the raid and in a subsequent so-called “Privilege Review”.


The danger to the DOJ’s case is so worrisome, McCarthy said, that DOJ is likely to immediately appeal the independent review decision. “They rolled the dice” on a Mar-a-Lago raid rather than simply bring the document dispute to the court for resolution of what if any rights Mr. Trump had in relation to the seized docs, McCarthy added, “and they may still win their point.” But, if not …
