Is Joe’s Student Loan Bone Legal?
8th Circuit temp blocked Biden’s student loan forgiveness scheme that would saddle taxpayers with $800+B total tab as national debt exceeds $31T. Maybe Joe’ll still prevail but are all “the courts on my side” as he insisted?
The key legal issue, of course, is a “Constitutional Separation of Powers” one since Mr. Biden issued his forgiveness plan without the approval of Congress. And, it’s a curious “Timing” issue since he made his announcement awfully close to the November mid-term elections, then, crowed the other day about how smart a lawyer he was when a Missouri court didn’t nix his scheme. Never mind that the judge did NOT rule on the merits, but that the parties in that particular case, GOP AGs arguing the forgiveness of debt would irreparably hurt their states, lacked “standing” or the power to litigate the issue. Meanwhile, as the WSJ notes, the GOP pols are arguing the whole idea behind Joe’s debt forgiveness … up to $20K per student … is an “attempt to win votes & is unfair to people who didn’t go to college, already paid off their loans or didn’t take out loans.”
Said Mr. Biden about the GOP deniers in a recent speech defending his loan forgiveness program: “Who in the hell do they think they are?” Maybe the courts or, if not, Congress or, if not, the voters will in the end ask Joe: “Who in the hell do you think you are?”
