Justices Trigger Gun Control Law Chaos
WSJ opines “Nation’s Gun Laws Are in Chaos” thanks to Sup Ct’s latest constitutional “clarification” that was clear as mud. Yet, wasn’t “lawyer-itis” aka parsing a ruling to death predictable? Recall aftermath of Roe’s abortion & Dred Scott’s human race fantasies.
The editorial board notes how judges nationwide are now “clash[ing] over history a year after [a majority of Justices] upended how courts decide 2nd Amendment cases.” That is, its decision in NY State Rifle & Pistol Assn v Bruen “decreed that gun-control laws of today must have a clear forerunner in weapons regulations around the time of the nation’s infancy, regardless of the modern public-safety rationale behind them.” As one appellate judge moaned, “It all baffles me …”
Yet, it wasn’t hard to predict lawyers on the short-end of the proverbial stick wouldn’t jump on that lack of judicial clarity to argue its “true” meaning until the true meaning is harder to divine than the mysteries of the universe. In similarly trying to calm combative folks over divisive legal rights, the Roe court tried to pretend unborn babies have no human right to life as the Scott court tried to pretend slaves weren’t humans with rights. Decades of judicial chaos ensued. Finally, mercifully, they were overturned, thereby righting the imbalance they unintentionally created. Now, today’s court shouldn’t wait decades before cleaning up this gun rights mess they certainly didn’t want to trigger.
