Kagan’s Supreme EPA Hysterics Squelched

Lib Justice Kagan’s outdid her hyperbole tendencies when she said parts of East Coast could be “swallowed by the Ocean” because the Supremes blocked the EPA from making up environmental rules without Congress’s ok.

Please. As the WSJ’s Kim Strassel notes, “the EPA case doesn’t preclude climate rules” as Justice Kagan’s rant suggested, but simply “required lawmakers to enact them.” Should be simple enough for any lawyer to grasp without a fearmongering over reaction. Yet, recall how the Justice’s own penchant for making up of rules while interpreting a supposedly “living” and, therefore, amendable by judicial fiat constitution. Even with that aside, Justice Kagan all but called the six colleagues in the EPA majority opinion foolish for stopping Biden, Pelosi & the EPA from re-writing the environmental laws with the stroke of their pens so THEY could force the “transition” of America from fossil to renewable fuels and no matter the disruption to the inflating & stagnating economy.

One might be tempted to wrongly say the Justice is just another hysterical ex-academic, having gotten promoted to the Supreme Court by President Obama in 2010 after running her progressive ideas up the proverbial flag pole while a Chicago & Harvard Law prof & later as US Solicitor General. Yet, if you look at what’s going on in our campuses & DOJ by way of woke mania, one can understand the temptation. And, that ain’t hyperbole.
