Musk, Napoleon & Constitution’s Reign

Elon Musk slammed NY Times writer for calling our Constitution “dangerous” but it’s so like the radicals making their justifications for chaos. Case in point was another writer arguing Constitution’s ok with overthrow of the federal govt.

The Musk dust up had to do with the tired argument that the Constitution’s Electoral College provision paved the way for a Trump to become president rather than simply ensure bigger states couldn’t stomp on the little ones. But, shouldn’t the popular vote “trump” the electoral college? The writer never heard of Napoleon Bonaparte becoming First Consul for Life in France with 3.5 million or 99.76% of the vote in a free national plebiscite; he later became Emperor with a similar overwhelming popular vote. So much for the peoples’ let alone politicians’ wisdom? Ok. But, how could it be that our Constitution “provides” for the overthrow of the federal government for whatever reason? We’re told the “Right to maintain a Militia” was supposedly put in the Constitution by our Founding Father to ensure the States were not suppressed by tyrants. Right. The Founding Fathers were anything but idiots who would point State Militias like a gun to their head rather than at foreign invaders, American Indian attacks or domestic insurrectionists.

Au contraire, as Ben Franklin would say, the Constitution was designed to punish “treason” and to “ensure domestic tranquility” that is based on the peace-loving Rule of Law. It so says after a bloody Revolution that freed Americans once & for all against foreign tyranny. Of course, the Declaration of Independence warned that in the course of human events, tyranny by foreign oppressors & without representation could, no, should be overthrown. But, the Revolution against the foreign British was precisely fought to end such conflict by the duly represented, not invite it with a Free to Revolt Card against a home grown representative government when someone felt oppressed.
