New York’s Nat’l Climate Tax Ruse

New York State’s progressives have struck again trying an old ruse to force ALL Americans to fund $75 billions worth of infrastructure projects under the guise of climate remediation.

You can’t make this up. The NY Gov actually signed a new law brutally taxing ALL energy companies working with fossil fuels … who will, as always, pass the illegal tax to folks in the 49 other states. As recently as 2021, the WSJ editors point out, the Second Circuit Court of Appeals dismissed a New York City lawsuit trying to hold fossil-fuel producers liable for their alleged climate impact: “The court held that state tort law could not be used ‘to hold multinational oil companies liable for the damages caused by global greenhouse gas emissions.’ Yet, that’s essentially what the state Dems in Albany are doing with legislation rather than litigation.” It won’t work. The US Supreme Court is already considering whether to hear a case (Sunoco v City of Honolulu) about whether federal law pre-empts such state & local government claims against companies to redress impossible to prove harms caused by global greenhouse gas emissions, then, somehow mete out punishment via contrived taxes that will ultimately be borne by consumers from coast to coast. And they’ll apply common sense as well as legal aka constitutional logic in striking this state law down.

On a more pragmatic note, as the WSJ pointed out, this progressive ruse is just another legal trick to cover up their incompetent spend & tax management that’s resulting in massive deficits as well as driving residents to flee to other states. It’s sad. But, it is not other peoples’ problem.
