No One Pardoned In BLM Protest Shooting?

Tex Gov wants to pardon Uber driver convicted of killing BLM protester who pointed an AK-47 at him? Prosecutor says Mr. Uber “instigated” the confrontation? Meaning he made Mr. BLM wave AK-47 as if a marching baton?


As the WSJ story relates, GOP Gov. Greg Abbott, a former state AG & Supreme Court Justice, has requested a Texas pardon board to give a green light to a gubernatorial pardon for Daniel Perry for fatally shooting Garrett Foster & vowed to sign the approval “as soon as it hits my desk.” Mr. Abbott said on Twitter the state’s “Stand Your Ground” law is among the nation’s strongest & “cannot be nullified by a jury or a Progressive DA.” The prosecutor, Travis County DA Jose Garza, however, countered his jurors listened to testimony for 2 weeks. “In a state that believes in upholding the … rule of law,” he said, the governor’s statement … is deeply troubling.”


What may be most troubling are the facts that emerged at trial & the sad outcome of July 25, 2020, i.e., in the wake of the George Floyd chaos sweeping the nation: “Mr. Perry, an Army sergeant who was working as an Uber driver, drove up to BLM marchers ... Mr. Foster, a 28-yr-old Air Force vet, was in a group of demonstrators who [then turned and] approached the car. Mr. Foster was openly carrying an AK-47 style rifle, which is legal in Texas. Mr. Perry told police that he believed Mr. Foster [began] aiming the rifle at him & he feared for his life when he opened fire with his revolver … Prosecutors [however] presented evidence that [Perry] ran a red light as he drove toward the marchers.” The jury was also shown a social media post by Perry worrying about “rioting outside my apartment” & how he might “kill a few people on my way to work.” Wouldn’t most BLM protesters demand that cops arrest any counter-protesters waving an AK-47 over their head if not at them? Wouldn’t any sensible Uber driver do a detour around gun-toting would-be customers? Anyone in Texas ever hear of lesser charge of “manslaughter”? In the end, jury had right to convict, Gov has right to pardon?
